Legal Services to Production Plants
One of the most difficult building processes is the expansion of existing facilities of the production plant, assuming that we do not stop production. Any stoppage of production causes huge losses, especially in the automotiv industry, because supplies to the assembly plant must be kept and timely.
The Act on supporting new investments, which has been in force since 30 June 2018, stipulates that the entire area of Poland designated for business activity will become a single investment zone. The new regulations allow for corporate income tax exemptions for investors for 10-15 years. Additional points are awarded to companies from the sector of small and medium-sized enterprises, as well as for their location in a district with a high unemployment rate or a middle town losing its social and economic functions. Bonuses are to be granted to those undertakings which influence the competitiveness and innovation of regional economies. Companies may also count on supporting their exports.
The Act on supporting new investments provides that any company in any town or commune will be able to apply for tax reliefs and preferential conditions. Preference will be given e.g. to investments related to the creation of research and development centres or shared services centres. Preferential treatment will be given to investors cooperating with Polish universities, developing a supply chain in Poland, creating new good workplaces, i.e. where the average salary is higher than the average national salary. It will also be equally important whether the investor belongs to a cluster (to develop cooperation within related sectors). The new regulations allow for tax exemptions for investors for the period of 10-15 years. Additional points are awarded to companies from the sector of small and medium enterprises, as well as for their location in a district with a high unemployment rate or a middle town losing its social and economic functions.
The Act expands the present investment opportunities offered by fourteen economic zones that have been in existence for over twenty years.
Legal services for production plants focus on the four following four areas:
- labour law
- commercial contracts
- court cases with customers of products
- the expansion of the production plant
In particular, the expansion of an existing production plant, i.e. the process of designing a building connected with the existing one, the tender for the contractor of works and the management of risks related to the threats of production disruptions or even a construction disaster at the contact point of buildings, are tasks for experienced construction lawyers.
Legal services for entrepreneurs being production plants is extremely important for production managers. It ensures safety in the operation of the production plant, relations with suppliers and customers as well as legal employee relations.
The R&D department also needs support in the following areas: protection of business secrets, registration of patents and trademarks, protection of know-how and protection against unfair competition.
Production plants often have their in-house legal departments, as well as they employ external law firms in more difficult cases, in which case we provide support to the plant director. A long distance between a production plant and a law firm is not a barrier today. The most important thing is the high level of legal services that we provide to our Clients all over Poland.
Additionally, corporate legal services are of great importance in the process of construction and operation of a manufacturer which usually operates as a limited liability company.
